Terms of Service

Effective date: May 6, 2026

These Terms of Service ("Terms") govern your use of the DonzHit.me website, mobile application, and related services (collectively, the "Service") operated by DonzHit LLC, a Texas Limited Liability Company ("DonzHit," "we," "us," or "our"). By accessing or using the Service you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Account & Authentication

The Service uses Google Sign-In for authentication. You are responsible for all activity that occurs under your account. You agree to keep your credentials secure and to notify us immediately of any unauthorized use.

3. User-Submitted Content

The Service allows you to submit two types of content:

• Incident Reports: Videos, photographs, and descriptions of traffic or pedestrian incidents.
• Street Talk Posts: Text-based community posts, observations, and discussion relevant to local transportation and road conditions.

You may also post comments and reactions on both Incident Reports and Street Talk Posts. All of the above are collectively referred to as "Content."

Ownership. You retain all copyright and other intellectual property rights in your Content. DonzHit LLC does not claim ownership of any Content you submit to the Service.

License Grant. By submitting Content to the Service, you grant DonzHit LLC and its affiliates, licensees, and authorized service providers a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license — and, to the extent your Content has already been publicly distributed through the Service or uploaded to a third-party platform on your behalf, an irrevocable license — to:

• Host, store, cache, and back up your Content on our servers and third-party cloud infrastructure;
• Reproduce, copy, and distribute your Content across any media, format, or distribution channel, whether now known or developed in the future;
• Publicly display and publicly perform your Content on the Service, on third-party platforms (including but not limited to YouTube), and in any promotional, marketing, or press context;
• Create derivative works from your Content, including but not limited to: generating AI-assisted commentary, reaction clips, or editorial overlays using your Incident Report as source material; extracting still frames and thumbnail images from videos; transcoding, compressing, or reformatting for technical compatibility across devices and platforms; overlaying captions, labels, or branding; and editing for length or display format;
• Translate and localize your text Content for display in other languages;
• Sublicense the rights above to third-party vendors and service providers (such as cloud hosting, AI processing, video encoding, and content delivery providers) solely to the extent necessary to operate and improve the Service;
• Use your Content in connection with promoting, advertising, and marketing the Service, related products, and DonzHit LLC's business, including in sample screenshots, demo videos, and press materials.

Scope and Duration. This license begins the moment you submit Content and continues for as long as necessary to fulfill the purposes described above. For Content that has been publicly distributed through the Service or uploaded to a third-party platform (such as YouTube) on your behalf prior to deletion, the license is irrevocable with respect to that distribution — DonzHit LLC cannot retroactively remove content already published on third-party platforms, and this license persists to the extent required to maintain that distribution.

No Compensation. You acknowledge that you will not receive any payment, royalty, revenue share, or other compensation for DonzHit LLC's exercise of the rights granted in this license.

Moral Rights. To the fullest extent permitted by applicable law, you waive any moral rights, rights of attribution, or rights of integrity you may have in your Content in connection with DonzHit LLC's exercise of the license above.

Deletion. You may delete your Content from the Service at any time through the app. Deletion removes your Content from the publicly visible Service. However, (a) backup and cached copies may persist for a limited technical retention period; (b) the license described above remains in effect with respect to any distribution that occurred before deletion; and (c) Content that was uploaded to YouTube or another third-party platform may remain on that platform subject to that platform's own terms.

By submitting Content you represent and warrant that:

• You are the owner of the Content or have all necessary rights, licenses, consents, and permissions to grant the license above.
• Incident Reports depict real incidents and are not fabricated, staged, altered, or misleading.
• The Content does not infringe any copyright, trademark, trade secret, right of publicity, privacy right, or other intellectual property or proprietary right of any person or entity.
• The Content does not violate any applicable law, including laws governing defamation, obscenity, or harassment.
• You have not included personal information (e.g., unobscured faces, license plates) in a manner that would constitute unlawful doxxing, stalking, or targeted harassment.
• If your Content includes the likeness, voice, or performance of any third party, you have obtained all required consents from those individuals.

4. Content Review & Moderation

Incident Reports are reviewed by DonzHit administrators before being made publicly visible. We reserve the right to reject, remove, or modify any Incident Report at our sole discretion, including reports that are off-topic, misleading, abusive, illegal, or otherwise inconsistent with the purpose of the Service.

Street Talk Posts and comments are published immediately upon submission by signed-in users. They are subject to community moderation: any user may flag a post for review. DonzHit administrators review flagged content and may remove it at their sole discretion. We reserve the right to remove any Street Talk Post or comment at any time without notice.

Users who repeatedly submit content that violates these Terms may have their access to the Service suspended or terminated.

5. Prohibited Uses

You agree not to:

• Submit false, fabricated, or maliciously edited Incident Reports.
• Post harassing, threatening, defamatory, or abusive content in Street Talk or comments.
• Use Street Talk or comments to spam, advertise, or promote unrelated commercial services.
• Use the Service to harass, threaten, or harm any individual.
• Attempt to reverse-engineer, scrape, or disrupt the Service.
• Upload Content that contains malware, spam, or illegal material.
• Use the Service for any commercial purpose without our prior written consent.

6. Community Reporting

The Service provides a mechanism for users to flag Content they believe violates these Terms. Submitting a flag is not a guarantee of removal. DonzHit LLC reviews flags at its sole discretion and may resolve or dismiss them as appropriate. Abuse of the flagging system (e.g., mass-flagging for non-violating content) may result in suspension of your account.

7. Third-Party Services

The Service integrates with third-party services including Google Maps, YouTube, Firebase, and Google AdMob (advertising). Your use of those services is subject to their respective terms and privacy policies. DonzHit LLC is not responsible for the practices of any third-party service.

8. Advertising

The Service displays third-party advertisements served by Google AdMob. We do not control the content of these advertisements. Ad preferences are managed through your device settings (iOS: Settings > Privacy > Advertising; Android: Google Settings > Ads).

9. Intellectual Property

The DonzHit.me name, logo, and all Service-related software, design, and text (excluding user-submitted Content) are the property of DonzHit LLC and are protected by copyright and trademark law. "DonzHit" and "DonzHit.me" are trademarks of DonzHit LLC.

10. Copyright & DMCA Takedown Policy

DonzHit LLC respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe that Content on the Service infringes your copyright, please submit a written notice to our designated DMCA agent containing all of the following:

• A physical or electronic signature of the copyright owner or an authorized agent.
• Identification of the copyrighted work you claim has been infringed.
• Identification of the material on the Service that you claim is infringing, with sufficient detail to locate it (e.g., a URL).
• Your contact information (name, address, telephone number, and email address).
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Upon receipt of a valid notice, we will remove or disable access to the allegedly infringing Content and notify the user who submitted it.

Counter-Notice: If you believe your Content was removed in error, you may submit a counter-notice to our DMCA agent containing: your signature; identification of the removed Content and its prior location; a statement under penalty of perjury that you have a good-faith belief the Content was removed by mistake or misidentification; your name, address, and phone number; and your consent to the jurisdiction of the federal district court for your district. Upon receipt of a valid counter-notice, we may restore the Content after 10–14 business days unless the complaining party seeks a court order.

Repeat Infringers: We will terminate the accounts of users who are repeat copyright infringers.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DONZHIT LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13. Indemnification

You agree to indemnify, defend, and hold harmless DonzHit LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your Content; (c) your violation of these Terms; or (d) your violation of any rights of another person or entity.

14. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. You may stop using the Service at any time. Sections 3, 9, 10, 11, 12, 13, and 15 of these Terms will survive any termination.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction in those courts.

16. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and DonzHit LLC regarding the Service and supersede all prior agreements.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date above. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
